Libyan Judicial Association Calls for Strengthened Independence and Unity of Judiciary

Tripoli: The Libyan Association of Members of Judicial Bodies has issued a series of recommendations following a scientific symposium held in Tripoli, emphasizing respect for judicial rulings and the unification of the judicial authority. Among the key recommendations were the establishment of a federation of human rights organizations and the creation of a national institution dedicated to defending the independence of the judiciary and the rule of law. According to Libyan News Agency, the concluding statement of the symposium, which focused on "The Role of Civil Society Organizations in Supporting the Independence of the Judiciary," highlighted the necessity of supporting the independence and unity of the judiciary. It stressed the importance of respecting judicial rulings issued by all courts and committing to their implementation. The Association asserted that the judiciary is a public matter affecting all segments of society, and protecting its independence is a collective responsibility for everyone. The symposium announced the creation of a "Federation of Human Rights Organizations" to serve as a national platform for coordinating efforts to protect the rule of law. It also called for the establishment of a "National Institution for the Defense of the Independence of the Judiciary and the Rule of Law," which would include legal professionals committed to safeguarding the judiciary from interference. Addressing the current judicial situation, the recommendations emphasized resolving the crisis internally, leveraging national expertise while avoiding external interference. The recommendations also urged the United Nations Support Mission in Libya (UNSMIL) to respect judicial sovereignty and focus on supporting national initiatives. Additionally, the Assembly called on the House of Representatives to adhere to its mandate during the transitional phase and avoid hastily enacting legislation concerning the judiciary. It warned that any unilateral legislation could lack legitimacy and be subject to challenge . The recommendations further stressed the necessity of respecting Constitutional Chamber rulings and ensuring the continued operation of the Supreme Judicial Council in line with existing legislation. The Assembly also urged the Council to activate the National Committee for Judicial Development and to consider legal initiatives from relevant authorities. The symposium included participants from the Supreme Judicial Council, judges, legal professionals, human rights activists, and representatives from civil society organizations. Presentations and research papers addressed the challenges facing civil society and its role in reinforcing judicial independence. At the event's conclusion, the association expressed appreciation to the Supreme Judicial Council and all participants, commending the efforts that contributed to the symposium's success.
